the county of san mateo is in charge and the county is not concerned about the cost. they say all they want is to help these families finally return home. >> it's awful. >> reporter: inez had to get a look at it. the spot where the gas pipe exploded two weeks ago where her granddaughter's childhood friend jessica died. >> she said i wish i could be more close to him now. >> reporter: morales was one of seven people killed. in three to four weeks this will be a blank canvas. what's left of the 35 homes gutted is cleared away. >> it's a sense of finality and a new beginning. >> for the county and the city is rebuilding and the steps homeownersville to take.

county environmental health service said what will exist in the space will be landing clean. once demolition and soil control are completed. they control environmentally hazardous dust that covers every inch of the area. that is a concern surrounding the blast site. the director said one person wants to look into getting an independent contractor. they said the county will try to provide resources for the homeowner, but won't be able to give them approval or financial help. these crews are working pain stakingly to get it right. if that means it takes longer, so be it. >> it's not a draw for the crews. >> they understand they are in somebody's home and dealing with individuals' property. >> the weather has been a big plus for these crews out here.

the judge's decision to allow the execution to happen. but the judge believes the state made the necessary changes to go forward. federal judge jeremy has given him a choice of how he wants to die. by a single injection or a three-drug method. the judge in the state should give brown another choice. life. >> we are asking that question. why now? why the rush to execute now? the attorney general is rushing this process and creating legal chaos. there is an enormous amount of uncertainties and serious questions that have not been answered. >> brown was sentenced to death for raping and murdering a 15-year-old in southern california. he will be the first inmate executed in almost years. the judge halted all executions in early 2006. take a closer look at the three-drug process and if inmates were suffering extreme pain during executions.

>> here the stakes are too high and there soom uncertainties to continue. the courts need to stop the proceedings so we can have a careful review of all the problems and the public concerns over lethal injection. >> brown will be the first to be executed in california's new lethal injection chamber which has been changed to meet the requirements. better equipment, lighting and space. pro death penalty supporters are happy to move forward with the execution. >> there has to be a measure of accountability and take a life, you deserve to lose your life. >> he didn't care for the 15-year-old. why should we put him through it. you put her in pain through it so do it. >> expect to see a flurry of legal activity. they are asking a marin county superior court to halt the election and ask the ninth

circuit to overturn the decision. live in san francisco, nbc bay area news. >> clarence ray allen was the last to be executed in the state in january of 2006. at that time the 76-year-old was the oldest death row inmate. he was convicted in 1980, ordering the murders of three people while in prison for another murder. a death of an inmate being restrained by officers is a homicide. isaiah downs weighed more than 300 pounds and that did play a role. he was cuff and forced to the ground and the sheriffs reportedly placed their weight on his back and neck, causing him to suffocate. police say they are still investigating and so far there have been no arrests. the family plan to file a wrongful death lawsuit. questions about mental competency could derail the trial against jaycee dugard's kidnapper. a judge suspended proceedings. lindsay paulo explain what is is

behind the move. >> phillip garrido is charged with kidnapping and raping with a buzz cut and a blank stare. they went on record questioning the ability to assist in his own defense and stand trial. she visited her home 20 times and reported her trouble in the meetings. >> when someone wants to go to trial for crazy reasons or not go to trial for crazy reasons that, person is not competent. that's what we are talking about. >> however, the district attorney said he is confident and garrido is confident. his own observations including the defendant looking away and seeming disinterested when his own lawyer talks to him are troubling. they suspended criminal proceedings pending a mental evaluation of garrido. it's an issue of fairness which

will not significantly delay a trial. >> in cases where somebody is seriously seriously ill, that delay is only maybe a couple of months. we are not talking about a significant delay in time. >> the next step will be determining the pram terse of the hearing. as the latest twist unfolded, garrido did not react. >> it didn't phase him. >> nbc bay area news. >> he will be back in court october 8th. his wife nancy's trial is still on track and is schedule for court a week from today. 15-year-old isaac brat died last friday after the driver of the car he was in spun out into the path of a tractor-trailer. four other students in the car were injured. the 16-year-old driver of the car has been charged with vehicular manslaughter and dui.

ridge of high pressure maxes out and close to 100 degrees around livermore. san jose may get close to breaking records. upper 90s by monday and we will see records fall. for the weekend, high pressure sets up and we will have to watch the conditions in the hills if the winds get too gusty. we may see warnings for sunday night, but at this point it doesn't look like it will get that gusty. 70s and 80s and perfect beach weather in santa cruz. high temperatures for the weekend and mostly in the upper 80s along the south coast. 50s and 60s and a mild night most of the night in the 60s. if your air conditioner is running overnight, that is the reason why. it will be a warm night out towards the trivalley. low 90s and close to 95 for los gatos. a look at the coastline and enough of a sea breeze to keep things pretty comfortable for pacifica and half moon bay. towards the east bay and 80s for oakland and pleasant hill for
